Terms of Service

By creating a DatePod account you agree to these terms. If you do not agree, do not use the service. These terms constitute a binding agreement between you and Waggle AI operating DatePod.ai.

DatePod is strictly intended for adults aged eighteen (18) years or older. By creating an account, you represent and warrant that: (a) you are at least 18 years of age as of the date of registration; (b) the date of birth you provide is true, accurate, and corresponds to the date of birth shown on the government-issued identification you submit for identity verification; and (c) you have the legal capacity to enter into a binding agreement in your jurisdiction of residence.

DatePod enforces the minimum-age requirement through both automated server-side validation of the date of birth you submit and, where required, manual review of the government-issued identification you provide through our identity verification partner. We may, in our sole discretion and without notice, suspend, restrict, or permanently terminate any account we reasonably believe belongs to a person under 18, and we may report apparent misrepresentation of age to law enforcement or to our identity-verification provider as permitted by law.

Knowingly providing false age information, using another person's identification, or attempting to circumvent age verification constitutes a material breach of these Terms and may constitute a violation of applicable law. Any account so created is void from inception, and no refunds will be issued for fees paid in connection with such an account. DatePod does not knowingly collect personal information from individuals under 18; if we learn that we have collected such information, we will delete it promptly in accordance with our Privacy Policy and applicable law, including the Children's Online Privacy Protection Act (COPPA) where applicable.

• —You are responsible for maintaining the security of your account credentials.
• —You must provide accurate information including your real name and date of birth.
• —You must complete identity verification before your profile becomes discoverable.
• —One account per person. Creating multiple accounts to circumvent restrictions will result in permanent ban.
• —Creating an employer or secondary account to access your own pod assessment violates these terms and will result in permanent suspension of all associated accounts.

You agree not to:

• —Impersonate any person or misrepresent your identity.
• —Upload content that is illegal, abusive, harassing, or explicit.
• —Use DatePod to solicit money, goods, or services from other members.
• —Harvest or scrape member data.
• —Use automated tools to interact with the platform.
• —Share your account credentials with any other person.
• —Attempt to circumvent identity verification or age verification.
• —Use AI-generated content in your voice interview.

Free accounts allow profile creation and discovery by paying members. Full platform access requires a paid subscription. Subscriptions automatically renew monthly until cancelled. San Diego founding members may instead purchase a one-time $4.99 lifetime pass, available to the first 1,000 qualifying San Diego subscribers. The lifetime pass is a one-time charge with no recurring billing. Standard pricing is $19.99/month.

You may cancel your monthly subscription at any time from account settings. Cancellation takes effect at the end of the current billing period. The one-time founding lifetime pass is non-recurring. We do not offer refunds for partial months or for the lifetime pass.

You own your voice interview recordings and photos. By submitting them to DatePod you grant us a limited license to use them to operate the service — generating your pod, displaying your profile to matches, and creating shareable cards you explicitly request. We do not claim ownership of your content. Deleting your account terminates this license and we delete your content within 24 hours.

You grant DatePod.ai and Waggle AI (collectively, "DatePod") a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, transferable, and sublicensable right and license to use, host, store, reproduce, modify, adapt, edit, translate, excerpt, create derivative works from, publicly perform, publicly display, broadcast, distribute, and otherwise exploit your voice recordings, voice likeness, profile photos, hero name, pseudonymous display name, dealbreaker statement, AI-generated pods, and other profile content you submit to the service (collectively, the "Promotional Materials"), in whole or in part, alone or in combination with other material, in any and all media and formats now known or hereafter developed, throughout the universe, in perpetuity, for any advertising, marketing, promotional, publicity, demonstration, editorial, training, research, or commercial purpose related to DatePod, without further notice, approval, attribution, accounting, or compensation to you.

This license expressly excludes your legal last name, email address, phone number, date of birth, government identification, precise street address, and payment information; DatePod will not use those identifiers in any public-facing promotional material. Your first name (or the hero name you choose), city, age, and voice may appear in Promotional Materials.

You waive any right to inspect or approve the Promotional Materials or the uses to which they may be applied, and you release DatePod, its affiliates, licensees, successors, and assigns from any and all claims arising out of such use, including claims for invasion of privacy, right of publicity, defamation, or compensation. This promotional license survives termination or deletion of your account with respect to Promotional Materials already incorporated into published or distributed campaigns prior to deletion; DatePod will make commercially reasonable efforts to discontinue new uses of your Promotional Materials in campaigns first published after deletion.

DatePod uses AI to generate relationship pods, Chemistry Spark Statements, and match suggestions. These are tools to support your decisions — not authoritative assessments. AI outputs may contain errors or biases. All connection and relationship decisions are yours alone. DatePod is not responsible for relationship outcomes.

DatePod verifies identity but cannot guarantee the safety of in-person meetings. Always meet in public places. Tell someone where you are going. Trust your instincts. Report concerning behavior through the in-app reporting system.

We may suspend or terminate accounts that violate these terms, engage in harmful behavior, or for any reason at our sole discretion with reasonable notice. You may delete your account at any time from account settings.

DatePod is provided as-is. We are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding any claim.

These terms are governed by the laws of the State of California. Disputes will be resolved in the courts of San Diego County, California.
